Our specialist asbestos and lead consultants are able to provide the surveys, management plans, advice and guidance to assist you with compliance in accordance with Control of Asbestos Regulations 2012 and Control of Lead at Work Regulations 2002.
On exposure, Asbestos and Lead can pose a significant harm to health, however the responsibilities and duties of the ‘Responsible Person’ are commonly misunderstood, utilising professional consultants to ensure the correct process and management plans is a common management approach.
Asbestos Management Surveys
All properties constructed prior to 2000 must have an Asbestos Management Survey in order to assess potential harm from Asbestos. The assessment is a visual, non-destructive survey to establish the presence of Asbestos. Once the survey is completed, a report will be supplied detailing the location of asbestos known to be present or where presumed. Should asbestos be suspected or present, an asbestos management plan is required as information on management for the ‘responsible person’.
An asbestos management survey is the current industry standard survey type. The purpose is to locate, ‘as far as reasonably practicable’, the presence and extent of any suspect asbestos containing materials in the building which could be damaged or disturbed during normal occupancy, including foreseeable maintenance and installation activities.
The surveyor will check the condition, quantity and location of all suspected asbestos containing materials identified during the asbestos management survey and detail in a report.
The asbestos management survey must be shared with contractors and all others who could undertake works that may disturb or release asbestos.
Asbestos Reinspections
Where asbestos is identified in the management survey, a reinspection should be undertaken periodically. Reinspection’s provide vital updates on asbestos, the condition, and the risk.
The specialist surveyor will check the condition, quantity and location of all known asbestos containing materials identified during previous inspections. Where changes have occurred, appropriate alterations will be made to the resultant report.
The H&S Executive recommends that asbestos reinspection’s are completed at least annually so that you have up to date information on which to base your asbestos management plan. The extent of reinspection shall include all areas already known to contain asbestos containing materials, and where possible any areas not accessed previously will be surveyed.
Asbestos R&D Surveys
Prior to any construction, refurbishment or demolition works (on property constructed prior to 2000), the ‘Responsible Person’ has a legal duty to complete an asbestos refurbishment or demolition survey which focusses specifically on the areas of work.
This is required as the works will likely expose and/or disturb parts of the property that were not inspected during the asbestos management survey. Remember; an asbestos management survey is non-destructive, so you can never rely on the findings prior to refurbishment or demolition works.
An asbestos R&D survey is essential at the planning phase of any works, and that all works are planned in consideration of the information contained within the report. The R&D survey report, along with information on asbestos should be shared with contractors and all others before they commence works that may disturb or release asbestos.
Asbestos Sampling
Sampling and analysis are standard and included where necessary during Management and R&D surveys.
Sometimes there may be a need for a specific suspect material sample outside of conventional surveying or reinspection activities, we are able to offer a focused service to satisfy this requirement.
Lead Paint Surveys
If the presence of Lead is suspected in a property or working area, the ‘Responsible Person’ should ensure a survey and risk assessment is undertaken prior to work commencing. The survey and assessment should be considered at the planning phase of works. A lead paint survey can be undertaken throughout, or in specific locations where the presence of lead is suspected.
The risk assessment will analyse whether lead paint is present and measure the specific quantity of it. Samples will be collected, and then analysed by an independent UKAS accredited laboratory to determine the lead content. This analysis will identify the percentage of lead content within each sample.
We’ll then provide a complete report based on the site observation and quantitative analysis of the paint coating samples taken during the survey. As part of the report, we work with you to ensure your compliance with the Control of Lead at Work Regulations 2002 by controlling and minimising your employees exposure to harmful lead paint
Asbestos & Lead – the Legal bit….What Is Required
If you own, manage or are planning works on a property that could present an asbestos risk, you have a duty in accordance with the Control of Asbestos Regulations 2012.
The importation, supply, and use of all forms of asbestos are banned. However, many buildings, and some plant and equipment, still contain asbestos-containing materials (ACMs) – e.g. built or refurbished before the year 2000.
If you own, manage or before you start any work in a building that might contain asbestos you need to do the following:
- Identify the risk from asbestos, undertake an asbestos management survey.
- Assess the risk from asbestos within the premises (risk assessment)
- Develop and implement a suitable Asbestos Management Plan
- Undertake Asbestos Reinspection’s (annually)
- Undertake an Asbestos Refurbishment Survey before works in any area of risk.
- Make all information on Asbestos available to all relevant persons (contractors etc.)
- Use a licensed contractor for any works on, or removal of asbestos.
